SMS Terms and Conditions

These SMS Terms and Conditions (“SMS Terms”) govern the text messages sent by InkAway LLC (“InkAway,” “we,” “us,” or “our”). By providing your mobile telephone number and agreeing to receive text messages from InkAway, you accept these SMS Terms.

1. Description of the Messaging Program

After receiving your express consent, InkAway may send customer-care, appointment-related, and treatment-related text messages. Messages may include:

Booking, rescheduling, cancellation, or appointment-management links
Appointment information and requested reminders
Treatment-related information you have requested
Confirmation of a requested staff callback
Requested follow-up and customer-care messages
Responses concerning directions, late arrivals, or other appointment-related assistance

Messages may be sent using automated technology, including an automatic telephone dialing system. InkAway does not use this program to send third-party marketing, and InkAway does not send marketing messages on behalf of any other business.

2. Consent and Enrollment

You may enroll in the messaging program by expressly agreeing during a telephone conversation with InkAway’s staff or AI receptionist, by submitting a form on our website that includes a clearly disclosed messaging consent checkbox, or through another clearly disclosed opt-in method.

Before sending text messages, InkAway will request a clear affirmative response to the following disclosure:

“InkAway can send appointment, scheduling, treatment-related, and requested follow-up text messages to this number. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to opt out. See our SMS Terms at inkawaylaser.com/sms-terms and Privacy Policy at inkawaylaser.com/privacy-policy.”

Text messages will be sent only after you clearly agree.

Consent is not a condition of purchasing any product or service.

Consent applies only to InkAway and only to the mobile number you provide. It is not transferable to any other business or affiliate.

3. Eligibility

You must be at least 18 years old to enroll in the messaging program. By enrolling, you represent that you are the account holder for the mobile telephone number you provide, or that you have the account holder’s permission to enroll that number. If you are under 18, a parent or legal guardian who is the account holder must consent on your behalf.

4. Message Frequency

Message frequency varies based on your appointments, requests, and interactions with InkAway. This is not a fixed-frequency subscription program.

5. Message and Data Charges

Message and data rates may apply according to your wireless service plan. InkAway is not responsible for charges imposed by your mobile carrier. Contact your carrier for details about your messaging and data plan.

6. Opting Out

You may cancel text messages at any time by replying STOP to any message from InkAway. We also honor the keywords END, CANCEL, UNSUBSCRIBE, and QUIT.

You may receive one final message confirming your opt-out. After that confirmation, InkAway will no longer send text messages to that number unless you expressly consent again.

You may reply UNSTOP or START to re-enroll after opting out.

You may also opt out by calling 484-840-8663 or emailing info@inkawaylaser.com. Opting out of text messages does not remove you from other forms of communication you have requested, such as email or telephone calls.

8. Privacy and Mobile Information

InkAway’s collection and use of your information is governed by the InkAway Privacy Policy.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. InkAway LLC does not share, sell, rent, or provide mobile telephone numbers, SMS opt-in information, or messaging consent data to third parties, affiliates, or lead generation companies. Text messaging originator opt-in data and consent are not shared with any third party for marketing purposes.

Mobile information may be disclosed only to the service providers that help InkAway deliver this messaging service — for example, our messaging platform and telecommunications providers — and only so those providers can transmit messages on our behalf. Those providers are prohibited from using the information for their own marketing purposes. Mobile information may also be disclosed where required by law, or where necessary to protect InkAway’s legal rights or the safety of others.

InkAway maintains records of SMS consent and opt-out requests as reasonably necessary to operate the messaging program and comply with applicable requirements.

9. Delivery and Carrier Availability

Text-message delivery is subject to effective transmission by your wireless carrier and network provider. Delivery is not guaranteed, and messages may be delayed or undelivered for reasons outside our control.

Wireless carriers are not liable for delayed or undelivered messages.

The program may not be available through every carrier, device, or service plan. Supported carriers may change without notice.

10. Telephone Number Changes

You agree to notify InkAway if you stop using, deactivate, or transfer the mobile number enrolled in the program. This helps prevent messages intended for you from being delivered to another person. You agree that InkAway is not liable for messages sent to a number you no longer control if you did not notify us of the change.

11. Suspension or Termination of the Program

InkAway may modify, suspend, or terminate the messaging program, or any individual’s participation in it, at any time and without notice, to the extent permitted by law.

12. Changes to These Terms

InkAway may update these SMS Terms when its messaging services or legal requirements change. The current version will always be posted at https://inkawaylaser.com/sms-terms/ with an updated effective date.

Your continued participation in the messaging program after an update becomes effective constitutes acceptance of the updated terms, subject to applicable law.
