• Appointment requests, scheduling preferences, and appointment history
• Treatment-related information you choose to share with us, such as tattoo details, skin type, relevant health background provided during consultation, and treatment progress

5. SMS/Text Messaging and Mobile Information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. InkAway LLC does not share, sell, rent, or provide mobile telephone numbers, SMS opt-in information, or messaging consent data to third parties, affiliates, or lead generation companies. Text messaging originator opt-in data and consent are not shared with any third party for marketing purposes.

Consent to receive text messages from InkAway applies only to InkAway. It is not transferable to, and is not shared with, any other business, affiliate, or downstream recipient.

How you enroll. When you provide InkAway with your mobile telephone number and expressly agree to receive text messages — during a telephone conversation with our staff or AI receptionist, through a web form, or through another clearly disclosed opt-in method — InkAway may send you appointment, scheduling, rescheduling, treatment-related, customer-care, and requested follow-up text messages. Messages may be sent using automated technology.

Message frequency. Message frequency varies based on your appointments, requests, and interactions with InkAway. This is not a fixed-frequency subscription program.

Rates. Message and data rates may apply according to your wireless service plan.

Consent is not required to buy. Consent to receive text messages is not a condition of purchasing any product or service.

Limited operational sharing. Mobile information may be disclosed only to the service providers that help InkAway deliver the messaging service you requested — for example, our messaging platform and telecommunications providers — and only so those providers can transmit messages on our behalf. These providers are contractually prohibited from using mobile information for their own marketing purposes or from selling or sharing it. Mobile information may also be disclosed where required by law, or where necessary to protect InkAway’s legal rights or the safety of others.

Recordkeeping. InkAway maintains records of SMS consent and opt-out requests as reasonably necessary to operate the messaging program and comply with applicable requirements.

6. Cookies, Analytics, and Advertising

We use cookies and similar technologies to remember your preferences, compile aggregate traffic data, understand how visitors use our website, and improve the experience we offer.

We use Google Analytics and Google Display Advertising features, and we work with advertising partners such as AdRoll, to measure website performance and to show InkAway ads to people who have previously visited our website. These partners may use cookies to serve ads based on your prior visits to our site or other sites on the internet.

• You can set your browser to refuse cookies or to alert you when cookies are being sent. Some parts of the website may not function properly if cookies are disabled.

Mobile telephone numbers, SMS opt-in information, and messaging consent data are excluded from all marketing-related sharing, as stated in Section 5.

We may share aggregated or de-identified information that cannot reasonably be used to identify you.

We use a variety of administrative, technical, and physical safeguards to protect the information we collect. Our website uses SSL/TLS encryption to protect sensitive information transmitted to us. Access to personal information is limited to staff and service providers who need it to do their jobs.

Payment card information is processed by our payment provider and is not stored on our servers after a transaction is completed.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Treatment-Related Information

Before-and-after photographs are used for marketing or educational purposes only with your separate written permission, which you may withdraw at any time.

We keep personal information for as long as needed to provide services to you, maintain accurate treatment and business records, resolve disputes, and comply with our legal, tax, and messaging-program recordkeeping obligations. When information is no longer needed for these purposes, we delete it or de-identify it.

• Opt out of text messages by replying STOP to any message, or by contacting us directly
• Unsubscribe from marketing emails using the unsubscribe link in any email we send
• Request access, correction, or deletion of the personal information we hold about you
• Ask us not to sell or share your personal information — although, as stated above, we do not sell it

InkAway complies with the Children’s Online Privacy Protection Act (COPPA). Our website and services are not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If we learn that we have collected information from a child under 13, we will delete it. We do not enroll anyone under 18 in our text messaging program without the consent of a parent or legal guardian who is the account holder for the mobile number.
